The Anatomy of an $8 Million Structured Settlement – Using a Life Care Plan to Document Damages in a Personal Injury Case

Many personal injury attorneys realize that a  Life Care Planner  is important in cases of catastrophic injury adult, but neglect to properly include the plan as part of the case damages.


A recent case example is William Kim, a 63-year-old married male born in Korea who was involved in an accident in 2015 resulting in tetraplegia, causing a loss of sensation from his shoulders downward, mostly on the right side.


He was evaluated at his home by the Life Care Planner one year after his accident. The evaluation consisted of a medical record review and a standard  Life Care Plan  Interview with Mr. Kim and his wife. Information was obtained regarding Mr. Kim’s home situation, as well as the family’s recommendations as to potential modifications to the house which included the installation of an elevator so Mr. Kim could access his second-floor bedroom, bathroom, and living area.


The Life Care Planner constructed the Plan with the family and made modifications that met the Kim family’s need to assist Mr. Kim in the performance of his day-to-day activities even though he required 24-hour care.


The defendants retained their own Life Care Planner who basically agreed with the Plaintiff’s Life Care Plan.


Due to the comprehensiveness of the Plaintiff’s Life Care Plan, the defendants agreed to settle the case for around the total amount of monies recommended in the plan, structured to over $8 Million.
