$1.175 Million Settlement Due to Establishment of Total Loss of Earning Capacity by Using a Vocational Expert

Many personal injury attorneys overlook a significant amount of case damages by not considering the injured person’s employability and earning capacity.

Mr. Brown had been employed for over 20 years as a Heavy Equipment Operator when he sustained injuries to his neck due to a motor vehicle accident.

At the time of the  vocational evaluation , he was wearing a soft cervical collar and ambulating with the assistance of a cane which he used for internal and external mobility. In addition, he was wearing a bone stimulator.

He was very motivated to return to work with several unsuccessful work attempts. While trying to be employed, Mr. Brown reported experiencing neck pain, left arm pain and numbness, low back pain, and headaches.

Soon after stopping work, he began receiving Social Security Disability Benefits, having been found unable to perform any substantial gainful activity by the U.S. Federal Government.

A Comprehensive Vocational Evaluation, consisting of a record review, standardized vocational interview, comprehensive  vocational test  battery of 12 different tests, and transferability of skills assessment, was performed.  The Vocational Expert determined that Mr. Brown was unemployable and had sustained a total loss of  earning capacity  over his work life due to his physical impairments.

Six weeks after the Vocational Evaluation report was completed, the case settled for $1.175 Million.

Occupational Assessment Services  has been involved as Vocational Experts in some of the largest verdicts in the United States, including Escobar vs the State of New Jersey which received a verdict of $166,000,000 and Verni vs Armark which received a $105,000,000 verdict. Without the use of the OAS Employability and Life Care Plan reports, these large verdicts may not have been achieved.

OAS is a Nationwide Vocational and   Life Care Plan Expert   service with offices in NJ, NY, FL, TX, CT, GA, NV, and CA. Life Care Plans offered by OAS always include an Employability Evaluation.
