Personal Injury

OAS Specializes in evaluating seriously injured individuals in Personal Injury, Medical Malpractice, Product Liability, Motor Vehicle Accident, and Slip and Fall cases. A vocational evaluation is necessary in cases where an individual's injury has affected the persons' ability to go back and perform the same type of work, or to perform work activity which requires less physical demands. A loss of earning capacity and household services assessment is also provided in Wrongful Death cases. A Life Care Plan is necessary to document damages in cases where the client has sustained Catastrophic Injuries.

Matrimonial/Divorce Cases

OAS is the foremost expert in the evaluation of spouses in matrimonial cases. We have served as a court appointed and impartial vocational expert in such cases.

We can evaluate an unemployed or underemployed spouse, as well as disabled spouses, to assess their employability and earning capacity.

The evaluation consists a vocational diagnostic interview, work and transferability skills analysis, and depending on the circumstances, vocational testing. Once this information has been obtained, an opinion is formulated as to the individual's ability to work and their earning capacity in the local labor market. In addition, at times a Labor Market Survey is conducted to document the availability of job openings in the spouse's geographical area.

A vocational evaluation assists the attorneys in determining the amount of earning capability in each case which assists in determining the alimony payments. A written report by a Certified Rehabilitation Counselor who is experienced in matrimonial cases can assist in the settlement of the case. Occupational Assessment Services has been performing forensic evaluations in matrimonial cases for over twenty years. Our work has led to a greater documentation of the earnings of underemployed, unemployed, and disabled spouses in the New York, New Jersey, Pennsylvania, Connecticut, and Florida areas.

Social Security Disability

Occupational Assessment Services, Inc. is one of the few Companies to have been approved to serve as Vocational Experts for the Office of Hearings and Appeals of the Social Security Administration. Since 1977, we have participated in over 2000 hearings as Vocational Experts for the administration, as well as over 750 cases where we have worked for claimants seeking benefits.

Based on our extensive knowledge of the Social Security Administration regulations, listings, and vocational grids, we can evaluate your claimant as to their ability to perform substantial gainful work activity. The vocational evaluation consists of a record review, vocational diagnostic interview, work and transferable skills analysis, and when necessary, testing to make a determination of the claimants ability to perform gainful work activity.

Our expert can assist you in documenting the effect of your claimant's impairment on their ability to perform substantial gainful work activity. A Vocational Evaluation can be useful in establishing the claimant's Social Security Disability claim in cases where a claimant:

  • Can no longer do their previous work.
  • Has a "non-exertional" impairment such as a hand injury.
  • Has a cervical or lumbar spine impairment.
  • Is under 45 years of age.
  • Is over 55 years of age.
  • Has a past work history of skilled work requiring a transferability of skills evaluation.
  • Has a psychiatric impairment such as severe depression.
  • Is developmentally disabled with an IQ of under 70.
  • Is unable to sit or stand for extended periods of time.

Based on a record review, along with a completed standardized vocational form, and a transferability of skills analysis using Social Security Disability approved government resources, Occupational Assessment Service’s Vocational Expert can render an opinion in a report as to the effect of age, education, past work experience, and impairments on the claimant’s ability to perform substantial gainful work activity. A vocational evaluation report can be rendered on a nationwide basis using local, state or federal government data.

No other expert has been involved in more cases and has been cited by the Federal District and Appeals court as to the use of a vocational evaluation being the type of evidence to be relied upon by the Federal Administrative Law Judge in determining disability of a claimant.

Workers Compensation

Occupational Assessment Services, Inc. has served as Vocational Experts in the State of New Jersey under the odd-lot doctrine, the Commonwealth of Pennsylvania, Massachusetts, New York, Florida, Connecticut and Maryland.

Based on our extensive knowledge of the various state Workers’ Compensation regulations, we can evaluate your claimant as to their ability to perform work in the local labor market, as well as make a determination as to the individual's loss of earning capacity. The vocational evaluation consists of a record review, vocational diagnostic interview, work and transferable skills analysis, and when necessary, testing to make a determination of the claimant’s ability to perform gainful work activity.

As assessment of the local labor market wages is made based on local Bureau of Labor Market wage research.

Wrongful Termination, Discrimination & Harassment

Occupational Assessment Services, Inc. has served as Vocational Experts for plaintiffs and defendants in Wrongful Termination, Sexual Harassment and Age, Sex and Disability Discrimination cases, as well as cases involving the American's with Disabilities Act.

In these cases, we provided a vocational evaluation which consists of a record review, vocational diagnostic interview, work and transferable skills analysis, and when necessary, testing to make a determination of the individual’s ability to perform gainful work activity, as well as their earning capacity in the local labor market. In addition, at times a Labor Market Survey is conducted to document the availability of job openings in the geographical area.

The vocational evaluation assists both plaintiff and defense attorneys in determining the effect a wrongful termination has on the earning capability of an individual after the incident. Research regarding job openings and wages for available positions using government and local sources is performed as part of the assessment. This information documents whether the plaintiff has conducted a reasonable job search and if the person has sustained any diminution of earnings capacity. A written report by a certified rehabilitation counselor who is experienced in termination cases can assist in documenting the case damages.
